We don&amp;#39;t think any one big thing rules them out.. there&amp;#39;s just a slight unease about the entire concept. Ian Scales reports.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&amp;nbsp;Are femtos - the small antenna unit mobile users can install inside their houses or offices to provide cellular coverage via broadband as an adjunct to the conventional radio network - a consumer play that YOU plug in to enhance your connectivity as a consumer?&lt;/p&gt;
&lt;p&gt;Or are they a network play that the operator plugs in for you to enhance HIS connectivity. If the latter, why would you be incentivised to even think about getting one (much less paying for one) and what does it say about the technical wizardry of the broadband mobile network that you have to start plugging in adjuncts just to get the service running properly? &lt;br /&gt;&lt;br /&gt;And if a femto is a consumer play, why would it be better than WiFi? Especially as, according to Manish Singh of femto specialist Continuous Computing, the target price for a femtocell is north of $50 dollars in the medium term (they think they&amp;#39;ve nearly got it to $100 now). &lt;/p&gt;
&lt;p&gt;WiFi costs a few dollars and already just appears in gadgets and gateways without any extra urging.&lt;br /&gt;&lt;br /&gt;We&lt;a href="http://www.telecomtv.com/comspace_videoDetail.aspx?v=4110&amp;amp;id=9645a575-ac27-48a0-a8d3-71798a97d026"&gt; interviewed Singh at the recent ITU Telecom World 2009 in Geneva&lt;/a&gt; where he told us that, for the first time, femto cells are going to be part and parcel of LTE deployment. The femtocell, he says, was very much introduced as a sort of afterthought in 3G deployment. First the network was rolled put and femtos came after the fact. &lt;br /&gt;&lt;br /&gt;&amp;quot;What changes with LTE,&amp;quot; claims Singh, &amp;quot;is that operators really have the opportunity to roll out femtos with their networks.&amp;quot; Essentially, the femto gets factored in from the start, he claims.&lt;br /&gt;&lt;br /&gt;Singh claims there is one US operator to go to trial by the end of this year, multiple other operators are lined up in Europe and Japan as well. &lt;p&gt;In its latest statistics, published in The World in 2009: ICT facts and figures, revealed rapid Information and Communications Technology (ICT) growth in many world regions in everything from mobile cellular subscriptions to fixed and mobile broadband, and from TV to computer penetration - with mobile technology acting as a key driver. &lt;/p&gt;
&lt;p&gt;Meanwhile, the Executive Vice Chairman (EVC) of the Nigerian Telecommunications Communications (NCC), Ernest Ndukwe, at the just concluded International Telecommunications Union (ITU) World 2009 forum and exhibition in Geneva, Switzerland, revealed that telecommunications investments in Nigeria now stood at $18 billion (N2.7 trillion) within the last eight years. &lt;/p&gt;
&lt;p&gt;Ndukwe added that the current investment figure is made up of about $12 billion from foreign direct investment while the balance is from investments made from and within the country since 2001. &lt;/p&gt;
&lt;p&gt;He said that the country is keen on attracting more investments so as to expand the needed services in the areas of internet and broadband services across the country, having made a remarkable inroads into voice telephony services, stressing that government&amp;#39;s invitation to the private sector for participation in the industry has paid off and led to the current success indices in the sector. &lt;/p&gt;
&lt;p&gt;&amp;quot;This tells me that the decision by government to liberalise was a very good one, indicating that this is why the current 68 million active subscriber lines recorded in the industry over just eight years in Nigeria have been variously described as a revolution. &lt;/p&gt;
&lt;p&gt;&amp;quot;The decision by Nigeria to implement a technologically-neutral regulation has resulted in investments in both the Global System for Mobile Communications (GSM)- and CDMA-based services and made diverse services available in Nigeria with investors attracting services from different points, thereby providing choices for Nigerian consumers. &lt;/p&gt;
&lt;p&gt;&amp;quot;Nigeria is today dominated by wireless services delivery, not just in the mobile sub-sector but also in the fixed wireless services&amp;quot;, stressed the EVC NCC &lt;/p&gt;
&lt;p&gt;Meanwhile, the ITU report stated that the brand new comprehensive data, forecasts and analysis on the global ICT market show that mobile growth is continuing unabated, with global mobile subscriptions expected to reach 4.6 billion by the end of the year, and mobile broadband subscriptions to top 600 million in 2009, having overtaken fixed broadband subscribers in 2008. &lt;/p&gt;
&lt;p&gt;It stated that mobile technologies are making major inroads toward extending ICTs in developing countries, with a number of nations launching and commercially offering IMT2000/3G networks and services. &lt;/p&gt;
&lt;p&gt;But the ITU&amp;#39;s statistics also highlight important regional discrepancies, with mobile broadband penetration rates still low in many African countries and other developing nations. &lt;/p&gt;
&lt;p&gt;More than a quarter of the world&amp;#39;s population is online and using the Internet, as of 2009. Ever-increasing numbers are opting for high-speed Internet access, with fixed broadband subscriber numbers more than tripling from 150 million in 2004 to an estimated 500 million by the end of 2009. &lt;/p&gt;
&lt;p&gt;Rapid high-speed Internet growth in the developed world contrasts starkly with the state of play in the developing world. In Africa, for example, there is only one fixed broadband subscriber for every 1,000 inhabitants, compared with Europe where there are some 200 subscribers per 1,000 people. The relative price for ICT services (especially broadband) is highest in Africa, the region with the lowest income levels. The report finds that China has the world&amp;#39;s largest fixed broadband market, overtaking its closest rival, the United States, at the end of 2008. &lt;/p&gt;
&lt;p&gt;ITU estimates show that three quarters of households now own a television set and over a quarter of people globally - some 1.9 billion - now have access to a computer at home. This demonstrates the huge market potential in developing countries, where TV penetration is already high, for converged devices, as the mobile, television and Internet worlds collide. Dr. Hamadoun Tour, ITU Secretary-General says: &amp;quot;ICTs are vital within developing countries to ensure that ordinary people can fully participate in the knowledge economy of the 21st century. We have seen a positive impact on services such as health and education in markets where ICT growth has been strong.&amp;quot; &lt;/p&gt;
&lt;p&gt;Within the United Nations system, ITU is the main source of internationally comparable data and statistics on ICT. The Market Information and Statistics Division of the Telecommunication Development Bureau (BDT) collects, harmonises and disseminates more than 100 telecommunication and ICT indicators from over 200 economies worldwide. Data are accessible online through the ICT Eye portal, on CD and in print publications. The Market Information and Statistics Division regularly publishes analytical reports illustrating the latest trends in the sector. It also monitors the development of the digital divide and has developed widely used benchmarking tools, such as the ICT Development Index (IDI). &lt;/p&gt;
&lt;p&gt;Sami Al Basheer, Director, Telecommunication Development Bureau, said, &amp;quot;we are encouraged to see so much growth across developed and developing regions, but there is still a large digital divide, and an impending broadband divide, which needs to be addressed urgently. &lt;/p&gt;
&lt;p&gt;Heads of State and industry leaders will collaborate at ITU Telecom World 2009 to identify the right policies and regulations to support and encourage future ICT growth worldwide. &lt;p&gt;Innovation in information and communications technologies during the economic downturn has brought shifts in the landscape with new technologies and newcomers in the market, according to speakers at a symposium organised by the World Intellectual Property Organization Arbitration and Mediation Center on 8 October. Meanwhile, dispute resolution involving intellectual property rights is on the rise, they said.&lt;span id="more-6783"&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;The symposium was held within the 2009 United Nations International Telecommunication Union (ITU) Telecom World event held from 5-9 October, which brought participants from 186 countries, according to organisers. &lt;/p&gt;
&lt;p&gt;There are four sources of disputes in ICTs, said Christian Bovet, vice president of the Swiss Federal Communications Commission: liberalisation, the development of networks, hardware and applications. &lt;/p&gt;
&lt;p&gt;In a way, monopoly situations are easier to handle, Bovet said, as liberalisation creates new types of disputes between incumbents and newcomers, or between operators and other actors.&lt;/p&gt;
&lt;p&gt;Richard Owens, director of the WIPO Copyright E-Commerce, Technology and Management Division, said the percentage of non-internet domain disputes at the WIPO Arbitration and Mediation Center is: patents, 46 percent, IT/telecom, 22 percent, copyright, 9 percent, and trademarks, 5 percent. &lt;/p&gt;
&lt;p&gt;There has been a large upswing in disputes in the ICT sector, according to Gordon Moir, vice president of British Telecom. An increased number of players from different sectors are seeing a converging environment, such as bundled services, where for example mobile operators are seeking fixed access, and fixed operators are seeking mobile. There also is increased complexity such as disputes over access to monopoly infrastructure, access to content, or rates for international carriage. Regulatory players are also more numerous with courts, competition authorities, regulators and policymakers, who are more and more engaged, said Moir.&lt;/p&gt;
&lt;p&gt;Richard Vary, senior intellectual property rights litigation counsel for Nokia, said interoperability standards are essential. An increase in standards and patents in ICTs has brought new challenges such as balancing the interests of the different actors, like patent holders, consumers, and third parties in dispute resolution. &lt;/p&gt;
&lt;p&gt;Other challenges for dispute resolution come from differences such as &amp;ldquo;national rights&amp;rdquo; and international industry, and issues such as the competence of tribunals in addressing a large number of patents, technical infringement arguments and IP validity. The process also needs to offer reasonable costs and timescales, Vary said.&lt;/p&gt;
&lt;p&gt;There is a gap between two models, said Richard Keck of law firm Macmillan Keck. On one hand is the regulated public utility model, which pushes towards openness with open access, rate regulations, and universal service obligations. On the other hand there is a push towards ownership under the traditional IP model, with patents, copyrights, trade secrets and privacy and data protection rights, he said. &lt;/p&gt;
&lt;p&gt;The same pattern exists with telecommunications, where the telecom regulator pushes from ownership to openness and the patent offices are pushing the other way, Keck said. &lt;/p&gt;
&lt;p&gt;Owens said WIPO has set up on request Expedited Arbitration for AGICOA, a collective society of film producers which collects for cable distribution. Contract disputes arise over royalties, and this mechanism allows for settlement if necessary. Now WIPO is establishing a new Arbitration and Mediation Center office in Singapore, which should open in January 2010. WIPO and the government of Singapore are developing a scheme for expedited arbitration for film and media-related disputes. &lt;/p&gt;
&lt;p&gt;YouTube Committed To Copyright Protection&lt;/p&gt;
&lt;p&gt;For Yoram Elkaim, senior legal counsel for South and Eastern Europe, Middle East and Africa at Google, every Google activity has some relation to copyright issues. Google acquired video-sharing website YouTube two years ago, said Elkaim, and about 20 minutes of video are added every single minute and 350 million unique users visit the site every month. &lt;/p&gt;
&lt;p&gt;The question is not whether the content on YouTube is copyrighted but rather if the content was posted by the rights holder, said Elkaim.&lt;/p&gt;
&lt;p&gt;Different rights can co-exist in a single video, such as screenplay, photography and sound recording. There are also different rights in different territories so it is sometimes difficult for a platform like YouTube to investigate, he said. However, YouTube has a longstanding commitment to copyright protection, Elkaim said.&lt;/p&gt;
&lt;p&gt;User education, prominent copyright warnings, and limiting regular user uploads to 10 minutes to avoid the upload of full-length commercial television programming and movies are all part of YouTube&amp;rsquo;s effort to limit infringement. YouTube also has set up a content identification system that allows them to &amp;ldquo;fingerprint&amp;rdquo; content to protect rights holders.&lt;/p&gt;
&lt;p&gt;Regulators should have a more active role in dispute resolution, said Pierre-Yves Gunter of Python and Peter in Switzerland. Commercial arbitration offers many advantages in telecommunications disputes, he said. Key factors include: the choice of arbitrators, their specialisation, their ability to grant interim relief, as well as the choice of applicable law, arbitration venue, language, and the limited grounds for appeal. The only disadvantages are costs and confidentially not being fully protected under institutional rules, said Gunter. &lt;/p&gt;
&lt;p&gt;With 4.6 billion mobile subscriptions globally by the end of 2009, according to the ITU, and a rapidly rising growth in ICTs in many parts of the world, the ITU World 2009 event called for increased collaboration and high-level dialogue in order to make global networks accessible to more users. The digital divide should be reduced and all actors should work towards the Millennium Development Goals, according to an ITU press release.&lt;/p&gt;
&lt;p&gt;Some technology experts also called upon the ITU to provide a platform to shape the global ICT standardisation landscape, according to an ITU press release. During a meeting held at the ITU on 6 October, ITU senior management and technology leaders, 19 private-sector chief technology officers called for a unified international approach to technology development. Standards are increasingly important in &amp;ldquo;the rapidly evolving information society,&amp;rdquo; they said, adding that standards are a &amp;ldquo;universal language&amp;rdquo; promoting innovation, effectiveness and efficiency.&lt;/p&gt;
